i agree 100% with your views on the 3 strike law,and i feel for teal,its totaly ludacris for that to happen to a person all on the account of one person crying foul,when that is not in itself anyway enough evidence for a juge to through someones life away.man us people need to unite america needs to tell it were it is this government is suposed to be by the people and for the people,but its not its becomin more like us and them,and its wrong government has become to big and to strong and we need to as people on a whole change that like voting those ideats out of office for starters,get laws changed to were the government doesnt have all the majority of power.i mean from the irs wich they need to abolish,to the fbi and cia,even the dea,they are the biggest drug dealers in the world its just plain wrong the shit those agincies to and get awa with..
This example of miscarriage of justice seems to be more common-place these days. I've read some real strange stories about the application of laws like these being implemented all over the country. California certainly seems to be breaking new ground, as far as stories like this go. There is the pizza bandit doing life for lifting a FEW slices, the macadamia nut buyer, the man with no crimes, Mr. Teal, the lady doing 50-life for writing a bad check... The list is endless. People need to wake up, it's getting strange..

I'm sick to death of our "judicial" system!!!!! I'd also like to know what the third person's respone on this means. "What about the first two strikes." It really does'nt matter what they are. Nobody should have to do time for nothing. Or for petty, nothing crimes. Let the time fit the crime. To many children, wives,parents,etc. having to live without their loved ones. Not for serious or violent crimes, but for stupid idiotic crimes. The politicians want you to think they're keeping the streets safe. Safe from what, the calculator theif, the guy who bought two macadamia nuts? It's nothing but a political ploy to get you to vote for them. PERIOD!!!!! Naive taxpayers pumping more money into the prison system than into education. Much more money.
continued... Come on Californian's, wake up. This three strike law is unconstitutional. Extremely expensive, and extremely hard on the families as well as the inmate. This law needs to be changed to all serious or violent crimes. Not any felony. I wish Bennie Teal good luck with everything. I also wish all the other men and women sentenced under three strikes for petty crimes good luck. May God bless us all. If everyone works together, we CAN get this law amended.

Sunday, May 17, 1998 -- Found you on FACTS - Families to Amend the 3 Strikes Law - I understand this blatant misuse of power and the frightening consequences of one person being empowered enough to steal another person's life with just a word.. a lie.. a vindictiveness. My husband is doing 29 years and 8 months in CDC, Lancaster California.. Not a 3 strikes case, but definitely an abuse of law and power. He is innocent of the crimes he was convicted of in San Bernardino County, and his trial attorney was appointed as a judge in Victorville after My husbands' sentencing. This judge even perjured himself to justify his lack of adequate defense for my husband when we attempted to gain a re-trial. It is an amazing story. The gulity person took a deal and was sentenced to about 4 years, did two and was released this Easter. My husband didn't take a deal when he was offered 2 years , then 4 years, then 8 etc.. He had believed that the system worked and that he would be found not guilty. He will never get the opportunity to make that mistake again. I can certainly believe what has happened to you and so many others. God help us all. I have no faith in the law or justice it is JUST US. Judges, Lawyers,Prosecutors, Legislators ... most are criminals in one way or another but who is taking them to task? We are at their mercy. Justice isn't the motivating factor in my opinion, it is greed and power, vote and moral sickness. My brother is no saint. His first felony-defending himself with a gun against a drug dealer(and his friends) that he informed on. He only wounded them and waited for police. His second felony-a carjacking he did not do. Even the owner of the car said it wasn't him. A witness conveniently picked him out of a six-pack( a set of six photos) He did time again. His third felony-drug dealing. He checked into a motel room with his girlfriend. They were in the process of getting an apartment together, and he was moving out of a Men's Home. Police were informed of drug dealings in that Motel. The day he checked in was the day he got a knock at the door. Police asked to search the room, to which he said sure because he had nothing to hide. The police found drugs in a bottom drawer

I have heard stories like this over and over. Society doesn't want to think about this law. Unless we are touched but it most of society feels that it's a good way to keep all criminals off the streets. They don't understand that this could effect any of us. What can we really do about abolishing this law? Is moving out of state the only way? I have a son who is due to be released in 5/00. He is a two-striker and will be 21 upon release. This law is so unforgiving and allows for no mercy. I am very frustrated!!

The state of Ca.is one of the most corrupt states I have ever encountered.How many of you know just what percentage of your police departments are run with 50% or more by NON-SWORN OFFICERS? These so called officers will lie,plant evidence, write false statements (police reports)commit warrantless searches of(home,property and vehicles)then take the witness stand and swear to tell the truth. We are considered GUILTY, until proven innocent. Lets not forget our local Sheriffs. I believe they are run with only 30% being non-sworn officers (or are they called non-sworn deputies?)here in Orange County California. No matter what THEY call themselves, our citizens need to start their own investigations on their local police agencies. Many of our Orange County Police Depts. have their own little TASK FORCES such as, N.E.T.( narcotic enforcement team)S.E.T. (who knows what this stands for, we'd have to ask Cypress P.D.) G.E.T. (GANG ENFORCEMENT TEAM), RUMOR HAS IT THAT THEY ARE TRAINED BY THE SAME PEOPLE WHO TRAINED L.A.s CRASH TASK FORCE,that should get all of us thinking. I don't know all of Bennie Teals circumstances about his case, but it's my belief that he didn't have a chance going up against our so called JUDICIAL SYSTEM ! thing CRASH FORCE. heir own investigations nts either. when i first heard of this law i put two and two together. this state put this law into place just to start privete sector prision. by having fortun 500 compaines running and operating these prisons the stat will be making lots of money. it will be slave labor. no more social security to pay because those who work in the prison industries can't collect it anyways doing a 25 to life sentence. and more likley with a 25 to life your going to a level four pen. and there your chances to come out are very slim for a young man. it's all about slave labor. while i was in prison i wrote a paper on this subject and sent it as a federal complaint to the us dist.court in nothern branch of calif judge Fren Smith and she rejected my ple for help on what is a clear violation of the fith amnd. of this country const. on dubble jepority. As of date i have 6 felonys and all strikable. i got out and started my own company and never looked back and all the time i was locked down i studied and read law books.im not the most learned person but i've took the position that i am the only person who can direct my lifes path and what im diong today will be a direct result of my future. im still on parole and just last night comming home from the studio i was pulled over. the officer had no cause to pull me over other than i was going 10 miles over the speed limit. wonce they found out i on high control parole, five car back up came. the fact that he did'nt even give me a ticket but ran threw my can and person like i was really involved in a crime. but i know today as i learnd the day i steped on that war zone level 4 priosn yard that..this is a direct result of my past behavior and this is the reality of a lifes gone to waste. but the cold part of it is that we put that on are self,Yes i know the system is dias and systmaticly exclude minorties.. but what i also learnd is as a people suffer from a pyscoligcal warfair.a physcosis call anglormaticdiscocation.
The federal government has recently announced the implementation of a *TWO STRIKE LAW* They are billing this as only to be used against pedophiles and such criminals. It's the "such criminals" people should be worried about. This in effect, gives them the right to turn California's three strike into a two strike law. Come on people, what the hell is going on here? I have so much compassion for people that have been affected, hurt, humiliated, unjustly sentenced cruely concerning the three strike law, or mandatory sentences, especially when a loved one of your own is involved. It hurts so bad. The scars and pain from this just soars so deep inside you that there is no words to describe it. I have been affected by this awful, unresonable, unjust law concerning a loved one of my own. This law lacks complete discretion, love, or balance that it can be so terribly abused by the prosecutors, cruel judges, and people in general alike who are basically ignorant if they fall prey to the belief that this heinous law could correct anything let alone criminals. What it does do is show that some people think a nation could be controlled by fear and unforgivness. There is no way on heaven or earth that this type of punishment would even come close to solving the lack of love, and understanding in the world at the present time which is what criminals are trully guilty of. Prison creates only better and more criminals the way it stands now. Rehabilitation is the only way we are going to get the world back on track. The system we have now is obviously not working. No one is perfect, and we all make mistakes. If the mistakes aren't that terrible no one should have to spend 25 years in prison for stealing a pizza or other stupid mistakes such as these. This is obviously ludicrous even to a person of an exceptionally low intelligence. If a person with such a low intelligence could figure this out, then what in the world is going on with these people in government office? Just exactly is going on? They just seem to be following rules that didn't seem to apply to anything except ritual or tradition. It all seemed senseless. No genuine sincere heart is what I saw and these are the people that are supposed to be running our lives these days? Making omoious unsermountable decisions as to whether we, or whoever we love stays in prison for the rest of their lives leaving children fatherless or motherless or worse. It is so traumatic. I am not saying that there aren't some honerable people out there, there are. With me and my loved one recent experience we weren't fortunate enough to have them, with honor on our side with enough power to make anything worthy happen in our case. This happens way to often to people and families that don't have the funds to hire a big powerful attorney. They sadly are at the mercy of the court system, when there can very often be no mercy at all whatsoever. Very sad. It can and will change. It has to. Life cannot go on this way. Write letters, get into active groups that are fighting for a better world. Presistance, love, prayers etc. not hatred will fight this and make it right eventually. The three strike and you're out law was made in response to regular law-abiding citizen's rights being violated by criminals. Greater good for the greater number of people. Hmmmmm, that works.
Whether constitutional or not, I think one must ask; why was this law passed in California? Were people sick and tired of the high rate of crime? Obviously there is some misuse of power when placing a life sentence on an individual who, for example, perpetrates a B and E. If we're talking a serious crime like murder, rape etc. then a life sentence is the only reasonable recourse a judge has.
My son was convicted on 3-Strikes in 1996, he was not given a speedy trial if he had of been he would not of been convicted on 3-strikes, because the law was not in effect when he was arrested.He will soon have served 7 years of a 25 to life sentence. His 3-rd strike was in possession of $3.00 worth of cocain. A lot of people are serving crimes not of violent nature, while rapist, child-molestors and murders are serving less sentences. I agree with that we need to find a way to punish our criminals. Especially since all of our california correctional facilities are completely full. And we are still shipping in more criminals evryday.
I think the 'Three Strike Law" should be inforced in all states and countries because the percentage of violence is going up per year and this may be the only way to stop it. I think no matter what if some one killed another person, whether he/she was drunk or not, they should get the Death Penalty. If you took some one's life then the same should be done to you!

criminals are not baseball players and each case should be handled accordingly. most of the time there are metagating circumstances that should always be taken in to consideration, nothing is that black or white. People can turn their lives around and then all of sudden something or someone does some unthinkable act to this individual that causes then to commint a crime because it may be the only thing this person can think of, They may belive they are alone in this world and do not know how to get heulp and after many great years of being a non crimial they revert back. If you are a felon some times it is almost impossible to get a good job no matter what, when you lose your self respect it is all over. Everyone needs a break, like I said though every case and person is totally different. We have all this white collar crime of the little getting ripped off and never paying for it. Well i was reading some one's feedback on April 16, 2003 and they said they got arrested for looking inside some one's trashcan. I believe they desrve it because they shouldn't be invading some one else's property. They should be sent to jail for life but they need some kind of punishment. Then they got caught doing it again so you know they're looking for more then a sprite bottle. So you can't really argue about that one plus you did it again so thats on you the first time okay but the 2nd time not okay. You feel me?
What has happened to this person is so wrong. I have a boyfriend who is trying to fight a 25 to life and this is a six almost seven year case. I wasnt with him at the time but i have been to courtwith him and when the officer took the stand he had no evidence of anything no paper work or anything. But since he is a felon they think he is guilty with no evidence. we do have to do something about the 3 strikes law before it does get worse. i hope that Mr. Teal does get out because because he doesnt deserve it either.

I do agree that there should be limitation on how the law should be inforced. The problem is, is that this country is supposed to be innocent until proven quilty, but its not. I certainly feel what your going through, because I have a daughter who is now 19 years of age who at the time this crime happened to her in July 2001, she was only 17 years old. Anyways someone else did a crime and because she was around they said accessory, so my daughter was barely sentenced May 8, 2003 and was given 2-strikes, 4 years prison time, 3 years probation, and a fine. She has never been to prison, and my thing is she was doubled sentenced, did not have the money to be represented fairly so they railroaded her and to this day Im still trying to find out what I can do because the system is unfair, especially to minorities.

Hello Everyone, I have spoken to a few of you about a Proposition that will be on this Novembers Ballot, Prop 66, The Three Strikes and Child Protection Act of 2004. Many Voters who helped to pass the well known Three Strike, your out law in 1994, were unfortunately ill informed on how this law would effect non-violent offenders. Since 1994, when the law was originally passed, over 55,000 NON-VIOLENT offenders have been sentenced to 25 years to life, for a NON-OFFENISIVE Crime. The numbers are increasing yearly, which will end up costing Tax Payers in California over 700 million dollars a year to house these Non-Violent offenders. Below I have attached a brief synopsis of Prop 66. He did change his life around baught a house and got married, and some other girl was the one who put him in prision. I need information on what i can do to help him out. I'am a mother of a three striker 32 yrs. My son has been High Desert state prison for 32 yrs. He had state Prison and his lawyer did nothing for 10 yrs. I spoke to a lawyer and he told me he should he told me he Mr. Tiffany should had done something within 60 or 30 days. So I guess he has to do all his 32 yrs. I want to help him but don't know how. His second strike came when someone accused him of theft however, it was never proven he still went to jail. Sorry to say his third strike came through his own falt. My point is that during the time he was out, he received several threats of a third strike if he didn't cooperate with the issues at had. Please reconsider your position on Proposition 66. The fundamental argument of those opposed to this narrowly crafted measure is that it will release 25,000 or more people from prison. This is a false and misleading interpretation and is based on an outrageous and distorted reading of the plain language of Proposition 66. In fact, the entire framework of the initiative's resentencing provisions refers ONLY to those who are serving 25 years to life for offenses that are neither violent nor serious. Proposition 66 will provide resentencing for only 3,500-4,000 nonviolent offenders. Furthermore, opponents' scare tactics have led them to numerous other distortions about the ways the law functions. It is not true, for example, that kidnapping is no longer on the list of offenses that trigger a strike. There are numerous examples of waste and injustice under our current Three Strikes law: --a man sentenced to 50 years to life for stealing videotapes. --a man sentenced to 25 years to life for stealing four cookies. --a woman sentenced to 25 years to life for stealing baby formula and baby diapers. Governor Schwarzenegger, I know that you are committed to a better California, an approach to government that does not waste our tax dollars, and to justice. Your decision in the clemency case of Pam Martinez, a former Third Striker, illustrated that approach, yet there are many currently imprisoned whose stories are just as egregious as Ms. Martinez's. Please reconsider your opposition to Proposition 66 while you gather more evidence and hear more about how it will really work. Below is an email that I wrote to my friends and family yesterday: I believe that we all need to vote Yes on Prop 66. The reason being is that everyone has someone either in their family or someone that they know in prison. This law was intended to keep the violent felons in prison for 25 years-to-life. The government states that our prisons are over populated, well of-course they are if we keep convicting the ones that have drug problems/shop lifting/ect based on the 3-strick law as it is now. Perhaps the law should be amended to prevent such gross miscarriages of justice, but it is wrong to assume that it does not offer some real benefit to our society. At least one benefit of the law is that it prevents dedicated criminals from continuing to prey on an innocent public, once they have been convicted a third time. And, a criminal does not have to be violent to be cruel and vicious. A case in point is Mark Ross Weinberg from Southern California. After defrauding his victims, he enjoys causing them ongoing grief. In an attempt to dissuade victims from pursuing repayment, or contact with authorities,Weinberg threatens mayhem and physical violence, but it is his ability to penetrate his victims' computers and telephones that causes the greatest damage. He sends warnings to a victim's entire e-mail list, which appear to come from the FBI, or other law enforcement agencies, accusing the victim of being under suspicion of the very sort of crimes Weinberg has committed. He contacts thei church, office of employment and neighbors with scurillous claims about the unsuspecting victim. Weinberg has been twice convicted and served years in prison but the experience has only accelerated his criminal activity. He has dozens of new victims, but was arrested by the FBI for new frauds on Wednesday the 15th of September. i think it depends on the crime.... what were the crimes?? what were his two stikes? i think that it does matter what he did? i have no idea what he did and what he was accused of doing(making a threat)i do believe that child molesters, rapists, and murderers do not need 3 stikes and if you do believe that they do need 3 strikes i bet you would not want someone who abused your child, your mother or sister or killed your loved one back out in the streets. i try to think about how i would feel if something like that would happen to me or someone that i love. if you mess up ok thats fine you get a second chance... what about the person that you harmed? if they were not killed then they have to live the rest of their life living with the pain. i have no problem paying for a convicted child molestors meals while he or she is in jail as long as they stay away from my kid and yours. i am aware that our judicial system has many flaws but i feel no pity for the above mentioned...

OK I have something to say! My son (22 years old) is currently in Prison for 7 years, his crimes are: residential burglary(No one was home, that is why they chose this particular residence) Grand theft auto (He stole his own car) and grand theft (For stealing something that happened to be worth a dollar amount that exceeds the limit for "petty" theft! NOT ONE of his crimes involved ANY VIOLENCE whatsoever!!!! He was never caught with a gun or any weapons for that matter, He has not hurt anyone other than himself! And for this he is losing 7 years of his young life!!!! The three strike law was pitched to us in California as a law that pertained ONLY to VIOLENT CRIMES!!!!!!!!!!!!!!! My brother has been in prison 2xs before. He got his life together and was doing good. My brother was on his brother property and this cop thought my brother was breaking into my other brother home but my brother had every right to be there.Before this officer even asked my brother was maced,handcuff and threw to the ground and beat. Afterwards this cop finds out from my other brother my brother had the right to be there. So then this cop decides he will try to find some other kind of charge on the brother he had maced. They tried to get him for breaking in and when that didn't work they tried to find stolen goods and when that didn't work they claim they found drugs in my oldest brother home. The place had been broken into many times and police reports were made and the law knows who broke in but won't charge the people. As soon as my brother was let go on a 20 hr. hold my brother went to the hospital for the cop had maced him and beat him. Well my brother called in the FBI and they didn't do nothing to this cop so this cop found out and made charges of resisting arrest. My brother has to do 4 years in the dept. of Corrections because he repoted a crime to the FBI and the Cop got mad and put the false charges on him. Also the ACLU was contacted but to date nothing has been done. This officer knew in the past before my brother life had changed he was in trouble and down 2xs. So this charge stuck and now my brother loses 4 years of his life and this makes strike 3 for him. Lies,corruption,beatings,maced. Noone seems to care for a Cop word is all they care about. My brother even asked for a lie detector test to prove he wasn't lying and wanted the Cop to do the same. No. That is not possible for this Cop to do this. This Cop used and played on my brother past 2xs in Prison to win his case because he was mad he was turned in to the FBI. I trusted the FBI,System,Courts,Cops but ask me now and I will tell you I don't trust the system at all. All on the word of 1 man. Freedom of speach is almost gone,our rights are almost gone. I think it is hi Hitler time.

I do agree with that the three strike law should be amended or atleast revised because of the effects on some of the smaller lesser crimes. i mean you could be a rapist and be able to do it three times... Go 25 for a small possession of marijuana just because its your third strike. sucks
I fell that the three law in ludacris, however i do believe that it is necessary for certain convictions of crimess. Say for instance a man convicted six times of crimial domestic violence, but gets off the seventh timee. This happen to close person in my life victimized of CDV and almost killed her. To me this type of person is harmful to our society.
