COURTROOM BEATING BY POLICE LEADS TO DEATH IN INDIANAPOLIS

  • On June 14, 1995, Joe Love, a 37 year-old cab driver from Indianapolis appeared in Marion County (IN) municipal court for a competency hearing stemming from an arrest for allegedly possessing a joint of marijuana. He died that same day in the courthouse lock-up. After a 48-hour investigation the police and Marion County Deputy Chief Coroner Robert Ward said Joe Love died of a heart attack. The Chief Medical Examiner of Kentucky, Dr. George R. Nichols, who conducted a second autopsy the day the body was released, said Joe died as a result of his carotid artery being crushed. He was choked to death by 3an arm bar hold.2 The second autopsy includes a five-page list of welts and bruises which were easily visible and were recorded in photographs. When the second autopsy information was made public, the Marion County Coroner9s office began postponing its official findings. When the new 3tentative cause of death2 was released on July 5, 1995, it was identified as 3positional asphyxia.2 The coroner claimed that Joe may have suffocated when someone sat on him in an attempt to subdue him. They still claimed, despite the second autopsy and the graphic photos, that 3there was no bruising and no signs of having been struck.2 As to the events in the courtroom, the judge and sheriff9s deputies have varying accounts which are sometimes self-contadictory and sometimes in conflict with the recorded court transcript. According to the transcript, Joe Love was never ordered into custody. Deputy Chief Billy Romeril said that Joe 3was the perpetrator, not us;2 however, eyewitnesses in the courtroom and other areas of the courthouse say Joe did not resist when he was set upon by more than a dozen deputies. According to these witnesses, he was kicked and pummeled on the courtroom floor in front of the bench. Joe was removed to the lock-up where he was placed in a 6 ft. by 7 ft. cell known as 3the hole.2 He died there.
