Hello,
I have been searching for information regarding illegal arrest and police misconduct. I have spent the last
5 days looking at penal and civic code. I am so confused. I had an altercation with the San Leandro Pd in
California Sunday evening. I was pulled into a parking stall next to a handicapped space. I was im the
area with the white hash marks in it. My friend ran in to get some cigarettes and came out in 2 minutes.
She was back in the car and I was begining to pull away when i heard a male voice ask if i was handicapped.
I turn and said no. A man in a police uniform told me I was parked in a handicapped stall. I opened my
door and showed him the painted wheelchair on the ground in the other parking space. He then ordered me
to get out of my car. I asked him why , he demanded I get out of my car. Keep in mind that I did not even
know if he really was a cop or not. I again asked him why and he proceeded to walk away from my car. I
shrugged and began pulling out of the stall. I turned out of the parking lot and he followed me. He pulled
me over and said fine then, how about reg, liscens, insurance. I of course complied and asked him why I had
been pulled over. He refused to tell me. I asked him his name and he refused to tell me. I gave him the information
except for proof of insurance. I stated to my friend that I knew I had it but could she help me look for it.
To this the officer stated awww, you have no insurance and he walked away from the car. I then got out of
the car and told him I was still looking and asked him why he was treating me this way. I told him he needed
to tell me why he had pulled me over.
He then opened the back of his police car, grabbed my arm and attempted to push me in the car. I screamed for
my friend who was in my car at the time and she jumped out and he let go of me. After a few minutes
elapsed, another officer showed up and the first officer told my friend to get in the fucking car or she would
be arrested. As he verbally abused her he began walking toward her, threateningly. I took one step toward
the officer and did not touch him or threaten him but started talking about how we were citizens and they
grabbed me and threw me on the back of the police car, cuffed me and frisked the outside and inside of my jacket.
The officers were white males and i am a white female. I demanded to know why I was being handcuffed and they told
me they did not have to tell me and that I needed to go take some law courses. I continued to ask why and
the officer told me to get the fuck in the car and he looked like he was going to hit me. I did and then they
stood outside laughing at me. I was yelling at them to let me out or tell me what was happening. I told them
that I had had a broken elbow and a dislocated shoulder (kess than a year ago) and that my arm does not bend
back that way and that it hurt. They just smiled at me. After 20 minutes they took me out of the car and released
my right arm and I moved it to the front of my body because it hurt. I was physically restrained again by the
officer who told me i could not move and he asked me if he needed to spell everything out for me. They then made
me sign a ticket for lack of insurance and gave me aqnother ticket for parking in a handicapped stall. I spoke to their
Srgnt. and have filed a complaint.

I was really sorry to hear about your situation. I feel the police are out of control and somthing needs to be done about it. Unfortunlately, I am trying to find out some information myself regardinga situation I have recently encountered. An arrest was made where the police planted drugs on someone I know and charged them with possession and intent to sell, as well as resisting arrest and for trying to destroy evidence. Hello Femalepaassion, I am a disabled person, and those white slashes are part of the disabled parking space - for those who have wheel chair lifts, we can wheel out of the van without concern about damaging a vehicle. You will notice some spaces say "van accessible" those slashes are normally around those particular space. I'm sorry you had such a hard time with the SLPD, I'd say that in the future to find a different place to wait for someone - so as to avoid such a problem. I guess you will think twice about parking in those white slashes, what you did was illegal. The way they treated you is inappropriate - I do know someone who works at the SLPD - and am certain he wouldn't treat a person that way for no apparant reason. Best of luck to you! Lynnette

Hi, My misadventure happened in Antioch when Police Officer approached my legally parked van and asked me to get out and show ID. As I reached for ID, he saw red handle of a small knife sticking out of my pocket. He grabbed it, said that it was a "Dirk or Dagger" and that I was carrying it concealed. Arrested, booked into Martinez Detention Center, Bail on this was 20,000, couldn't and wouldn't post, spent 3 days there. Released, arrest changed to detention, DA pondering whethere to file charges. Searched Ca. Codes and can not find anything that gives the State authority to imprison anyone for 72 hours. Codes clearly state that I should have been brought before a magistrate ASAP. Does anyone know where they get their authority for confinement on suspision??

1st...don't park in the hashed area. Drivers ed says don't do it. Second....try to be civil and you will be treated the same way. I was not there so I do not know. I do know that I am police officer and I tend to treat others like I am treated. If you were blocking a space....so be it. Live and learn. If you think back, could you have handled it any better?????? Don't judge the guy who spends 10 hours a day fighting for your rights and saving your stuff from getting stolen. Having done this for 11 years now, I can tell you the biggest complaint I get form people on the street is why healthy people park in these spaces........ Hi I was involved in a very complex misconduct case and I know people who where victims of brutality in Suffolk county New York, It would take a couple of pages to explain, I think the girl in the opening article is way off base, but their are many cases that need to be followed closer, I would also like to note that my county is home of the highest paid cops who next to nothing compared to the NYPD who risk their lives everyday, and in suffolk county the even the lowest ranked offices live in million dollar homes.

i am harassed by the slpd all the time and need to know where to start to file a complaint. they have tore up my car they have made me sit in the cold at 6:30 a.m. with my 8 day old newborn, and destroy my personal belongings when they search my house ALL THE TIME !!!!And they show up at my house at 11:30 p.m. last night and ordered me and my friends to step outside so they can search my house. Because they have nothing better to do, as one of the officers stated to me when I asked them if this was a probation search.Last night makes approx. 10 times in 1 year they have harassed me, and my child. You must have been at the greenhouse when you where messed with by them.
I had a bad experience today with LAPD. I would appreciate any information of help you have been provided to assist me in determining what my legal rights are. I was handcuffed. I asked if I was under arrest and I was told 'NO" I am investigating the possible breaking of the law and while I am investigationg you are being detained in handcuffs. We'll it worsened from there . . . I won't bore you with the details but I was eventually release and not taken into the station. I don't get it. I myself work for a police department and we also have a large problem with people parking in handicapped spots. While we do cite them for their offense as it is illegal to park in such a spot, to go to such an extreme is insane. In our department, we don't even treat real criminals that harshly unless we actually have to. Suck conduct is not only very inappropriate and unprofessional, it is ILLGEAL. While I normally side with the police on said situations, I hope the officers responsible get what they deserve, jail time. And we all know what happens to cops in jail.......

i was aressted for no reason the officer tresspass from my own place and that wasn't fair....and later on arrested me fro tresspassing......i couldn't even stay at my own place just being out side...

You are not unique in your experience, unfortunately. This type of thing happens to people everyday in our country. We wage full scale wars in far off lands fighting for these people rights and freedoms paid for by our taxes. Yet; It is our rights and freedoms that get trampled upon every single day. Why are we cleaning up others homes while ours gets no attention. Should we not be sure that our american citizens rights and freedoms are completely safe before non-american citizens. I thought the government is full of people that we put in the position they hold to represent us and fight for our best interest. I guess I was wrong. An officer has to tell you why you are being detained it is your right. They must give you teir name and badge number upon request. If they physically abuse you without cause or use excessive force under any circumstance it is a violation of your civil rights. Reporting it to the police supervisor or station is the first step for documentation purposes but, it would probably get swept under the rug. that is why you should contact the department of justice and/or the F.B.I. since they handle civl rights investigations. Vioalations of ones civil rights is a federal offense and therefore can be prosecuted in federal courts. with no bias or favortism.
Greetings Abused Female Citizen, Sorry to hear about your experience at the hands of some the communities finest. Well, I am not really sure just how to approach your situation. My only suggestion is to seach the Web. There is tons of information on Police Misconduct. I think it would help if you start with a little history on the subject. I suggest start around the turn of the century, the labor movement, industry and law enforcement alliegance with industry. Then move forward to the twenties and thirties. Pick it up again after the WWII, with the Hollywood Blacklistings, and on though the McCarthy era. Depending on your age group if you remember, the sixties were especially oppressive days for dissents and police on citizen abuse though out America. Oh yes, don't expect conditions to get any better, when many big city police entities received training and equipment from the military. It sounds to me like your civile rights have been violated. If this is the case. The cops have comitted a federal crime.
How many real crimes were being committed while you were busy smarting off to the officers? If you would have first off not violated the law by parking illegally, and second, just said yes sir, and thank you sir, you probably would have been released without incident. Instead, you ran your smart mouth, insulted, challenged and harassed the officers by acting like a know-it-all and kept them busy instead of fighting real crimes. Police have better things to do than tolerate trash talk from a little snot. They could have been preventing burglaries, etc, but instead they were spending their time putting up with you. You couldn't pay me enough to be a cop, they have a tough enough job to do without taking crap from an arrogant little snot such as yourself. We rely on the police to be there when we need them. I was arrested 2 years ago while sitting in my car in my driveway listening to music. SL police pulled in behind my vehicle and tapped on my window. I rolled it down and he said my music was too loud so I said ok, turned it down, and rolled up my window. He then motioned to roll the window down and asked for id. I explained it was in the house as I already had gone in to get cds and I didn't have a cd player inside. His buddy cop in the meantime was harrasing my passenger with the same questions and ordered him out of the car after he answered no to being asked if he had a drivers license. He searched my friend and found his CA id in his wallet and accused him of lying about an id. My passenger replied he answered no to the question of a drivers license, not an id. The officer then arrested him for drunk in public. I explained that we are on private property in the legal feet necessary from the curb and if they were taking him they'd have to take me. When he arrested me i asked what for and he said drunk in public. I told him i wanted a breathilyser and he refused because i wasn't driving. I insisted he couldn't take me for drunk in public without a test and I wanted one at the station because it was my right. At the station he actually looked it up in the code book and didn't apprectiate the humor of faking him out. Although separated, my passenger and I made noise all night and the officer finally came back asking the proximity of my daughters bedroom in the house. I told him do not go over and wake her up, she's 13 and fine. Two officers did use my key to enter and woke her to tell her I was in jail. I was released first in the morning and forced to sign a bogus rendition of the evenings events. When I first refused to sign because it wasn't accurate,(it stated I was arrested for disorderly conduct, I was told by the female **** that if i wanted out i had to sign it. I did also stating signed under duress. Then she told me I couldn't sit on the public patio outside the station to wait for my friend or she would rearrest me. He was released an hour later and went through the same with her. No charges, just inconvience and their power trip.

My girlfriend was at work this morning and she got their some what early but theres always workers in the warehouse working earlier then her. This morning no one was there at all and she has a key to the main office. She did what she does every morning and opens the door and sits at her desk in the front. She then notices a beeping noise coming from the other room and she suddenly realized no one had turned off the office alarm and she did not have a new code becuse she has only been working there for about 8 weeks now. After about four minutes the san leandro police come to the office with their guns drawn yelling at my g/f to put her hands up. Mind you theres no sign of forced entry, theres nothing in her hands like she has a gun or stealing somthing and her car was parked in the usual stall. She was so shocked at the situation she froze up and couldn't get her hands in the air because of her fear. My g/f is 1/2 blk and 1/2 mexican, very professionaly dressed so on and so on. Once they enetered her office they threw her on the floor and put her hands behind her back and just yelled shut up shut up! She kept on trying to say she worked there and she tried to explain the problem with the alarm and all they replied with was shut the fuck up !!!! They then put her in hand cuffs, and asked if the silver VW was hers in the parking lot and she replied with yes. It was locked and they forced a search of her car on her without any reason. THey then hurt her back and arms from throwing her around on the floor and in the police car. Mind you my g/f is only 5'3" 115 lbs and the police offers were all over 5'11" or 6ft and white officers. I lived in Alameda for 16 years, and heard throughout my youth that everyone was guilty until proven innocent. Here's my advice to you, I'm a law student in WA now. First, don't say a word. Once you have identified yourself, you do not need to say another word. 85% of people charged gave THEMSELVES up, and about the same number who are arrested, but not charged, kept their mouth quiet, and there was no evidence to continue. They will bait you into an argument just to get you talking. Second, let them do what they want at the time, and let them know you're going to nail them with the book they're hitting you with. Someone who let's them know that this arrest will bring a complaint, a letter to the Chief, and a Citizen Review Board inquiry is a lot more likely to think hauling you in is not worth it than if you call them pigs or act like you're not very smart. I've had handcuffs on, been stuck in the back of squad cars, but have not a single blemish on my criminal record. Why? Because I shut up! I actually went to the tank for obstruction once, but was released without charge because I reminded the Public Defender to tell the D.A. that I wasn't read Miranda, that the officer arrested me in someone elses jurisdiction, and that remaining silent was not a crime, even if it pisses the piggies off. I was told while waiting for arraignment that the charges were dropped, and I was home a few hours later. Third, and most importantly, remember that these same cops who told you to take law classes themselves are barely high school educated, and most only had the qualifications to serve in the military before becoming cops. These are not the cream of the crop, they all have terrible attitudes, and their lack of education has made a lot of people rich. Hopefully, you sued them for brutality. If it makes you feel better, my wifes mother works at a state prison here, and she tells me they have an entire pod dedicated to segregating former police officers who are now in prison, including former chiefs. Their buttholes now tell them that they were not above the law. (Sorry for being gross.)I know it's been a while since you posted this, but hopefully it will be of use to you.
I am a criminal justice student and also have a disability. I would like you to understand that you were indeed breaking the law, however it didn't justify the maltreatment that you received at the hands of the police. You need to see if your area has a citizen's review board or an internal affairs division. If it has either one of these agencies, you can file a citizen complaint against the officers in question. You will need to provide a detailed account of the incident and so will your witness. Keep in mind that you are fighting with the very agency that is supposed to protect you, therefore do not be surprised if you can not get service when you need it, as you live in a relatively small area. I do not condone their behavior, just letting you know what you are in for in the long run. Slow response times and a label of hostile toward police will probably be the immediate results, once you get someone from IA or the CRB to address your complaint, you may received recompense for their abusive conduct, or you may not. Good luck and please post your results as I would like to know the outcome.

Who police's the police? We live in Livermore California. While on our own private property, my husband was arrested and spent 24 hours in jail for public intoxication...mind you it was a Friday, evening time and after a long week, we enjoy having a few beers to end our week days. The arrest was on private property in our own front yard. I too have been a victim of the piggs. The San Leandro police make the Keystone Cops look in comparison like gifted geniuses, e.g., people who graduated from Med Shool at the age of 12, or people who won the Westinghouse Science Talent competition, e.g. Ron Unz, Math I.Q. 200+, etc. The San Leandro police even make Groucho Marx look like Albert Einstein. I get so sick of seeing these people hanging out at their little "traffic trap" they have set up on East 14th, several blocks south of Davis... especially the "bicycle butthead battillion" they've got stationed right outside Quizno's, that I no longer go into that area of downtown San Leandro anymore, and if I absolutely must, I bring along a vomit bag in case I get so sick I have to puke. Then they call in their backups like they think you just pulled a bank heist or something. Even if I fill up the vomit bag, at least I'll have something to contribute to the "PAL" (Police Athletic League). The hash marks are part of the handicapped space. They are there so cars with ramps and people who need assistive devices can enter and exit their cars. Also 2 minutes may not seem like a long time to you but when you have nerve damage to all four limbs from a spinal injury, and simple things like showering and getting dressed in the morning takes 2 hours, two minutes is a long time. It takes me four or five times longer to do everything you have to do, but I still have just the same 24 hours to do it in. So your 2 minutes is now ten. Its kind of like dog years to human years. Plus I donb I recently watched a guy sit in a handicapped parking space for about 20 minutes. I then got out of my car and went over to him. When I asked if he was handicapped he said his wife was. After he had been in the spot a half hour (I was back in my car waiting for another of the 2 spots to become free) a cop came by on patrol and asked the guy why he wasnb I am handicapped and about 35 to 40% of the time I find people who are just lazy and thoughtless parking in the handicapped spot for "just a minute". How do I know you are a lazy and thoughtless person? Because before my spinal injury I used to be like you. Well not completely. My teacher had the same happen to her in chicago. She was detained without charged and sworn at by several police officers for no reason. They let her go and she went to class and taught. She never found out (to this day) why she was stopped at treated so disrespectfully.

Cross sections of white are for unloading of disabled person(s) or equipment used for disabled persons that have proper marked attire on vehicle(s). Vehicles must be parked in a handicap slot marked for blue however a vehicle may not be parked on cross white sections, as same for yellow or red cross sections regardless of age, race, gender, and disability (this last statment attests to parking on cross sections designated for non parking). 2. A Police officer has reason and probable cause to investigate the incident in viewing of there own accounting or from complaints from citizens or private business's. 3. As result from the above the officer may check occupants in vehicles for warrents, re-takes, etc. during the parked traffic investigation. License and insurance/registration of vehicle must be provided upon request of officer(s). 4. State statue(s) depict that any individual in a vehicle may be detained for investigations when a violation has occured. It also allows persons to be detained for other investigating purposes if no crime has been commited. 5. Failure to obey emergency personnel (Police Officer). You were in wrong doing to begin with and had commited a parking violation. Failure to comply will or can be resulted in charges in resisting or obstructing a officer or added charges. Further more you had just left the scene. This is and can be pursued by police as failure to comply and obstructing with the intent to evade law enforcement in the event of a pursuit. 6. You had obstructed a officer in a investigation. You left the scene with your own intent that you had commited no crime. -Officer may have been going to radio for a secondary unit because of your combatant attitude. Further more from your own statements, you said you did not know if the uniformed man was a officer, possibly resulting in you leaving. However he was wearing the City uniform, in a marked emergency vehicle that the city uses with emergency equipment, and had government exempt plates. 7. Traffic stop was legal after the incident. Officer is further more investigating the reason of your combatant attempt to avoid him and reason for deny of proper vehicle documents as well as failure to provide proper I.D. or data that may result in public or officer safety issues later on in his investigation(s) of the parking violation during the prior stop. 8. Legal detaining for the investigation. You were failing to obey a officer in a investigation. 9. Obstructing/resisting detention upon a investigation. Officer for his safety was going to place you in his patrol unit. Safety is also for the other person(s) in the vehicle and the public. You then resisted and called for help from the other occupant. Occupant 2 then made physical gestures to approach officer and help you evade detention. I can keep going but basically, after this you were combative, disruptive, and as you stated "yelling". You were searched for there safety and yours. Sex and race was not a factor here. You commited the violation and left during the first investigation. You have to think of it as this, every person arrested says "i had surgery or broken bones" and many carry weapons. Many also dont have insurance. They are combative. Many claim "your not a real cop". if he wasnt a cop to you, then why not dial 911 and ask , i am being pulled over by a vehicle and I believe its not a police officer? If no cell phone why not roll you windows down a inche and request a supervisor, and another uniformed officer? You were in the wrong, young and thinking you can get out of it. You fell into the categories of regular persons evading and resisting. Next time obey laws. 10.

The area next to disabled spaces with the white hash marks is part of the disabled space. This area is used for wheelchair lifts and other types of assistance equipment. You should not have been parked there, stupid.

What you need to do is find out if anyone witnessed this, a passerby. the person in the car with you can't be a reliable witness, however someone who might have seen what happened could be.
