Police Evict NYC Squatters in Heavily Armored Raid

  • This Event Happened in New York City, USA



  • 5:30 a.m., police helicopters hovered above,
    overseeing a massive formation of riot cops
    who moved in with armored personnel carriers
    and heavy equipment to mass evict about
    150 homesteaders from 3 buildings on east
    13th street in New York City's East Village.
    The residents barricaded the street with an
    overturned car and dumpsters, etc. to slow down
    the impending assault.
    
    An armored personnel carrier cleared a
    path for the SWAT teams, armed with automatic
    weapons, who broke through the many layers of
    obsticals and barriers to forcibly evict the
    squatters from their homes.  The residents used
    non-violent resistance and civil disobedience
    tactics to hold their ground, but the police
    violently pried them from their strongholds
    while keeping cameras and the media far from
    view.  Around 30 people were arrested, some hurt
    by the heavy handed tactics used by police to
    carry out their mission.
    
    
    
    The residents have lived in the buildings for
    over 10 years, and include families and young children.
    They have been engaged in a court battle over ownership of
    the once abandoned city-owned buildings which
    the homesteaders had recovered and renovated
    over the years.
    
    The once drug-infested buildings were
    transformed from urban blight
    into a thriving part of the local community.
    
    
    The city declared the buildings unsafe as a
    pretext for the raid, in order to circumvent
    legal proceedings pending in court as to
    wheather or not the squatters have a right to
    continue living in the buildings
    which were abandoned in the mid 70's, and were
    owned by New York City.  There is a plan to
    develop "low income housing" on the site of the
    existing structures.
    
    About a year ago the city decided they wanted
    these five buildings that
    squatters had worked to save from decay,
    transforming them into a thriving community. 
    Judge Elliot Wilk of State Supreme Court ruled
    the city should not evict and ordered detailed
    hearings into the city's years of neglect of low
    income housing.   To prevent the hearings from
    continuing the city used an unfair and
    unconstitutional law that allows them to ignore
    the rulings of a judge.  The police showed up in
    force to enforce a vacate order issued by the
    Department of Housing Preservation and
    Development (HPD) to clear the buildings because
    of dubious reports of hazardous conditions. 
    This was NOT a court order--only a declaration
    by someone in the HPD who wanted the squatters
    out to clear the way for a questionable plan to
    develop "low income housing" which would revert
    back to market rate housing in 10 years.
    
    The judge is very upset with the city's
    desperate and provocative attempts to circumvent
    the law. Squatters say they only want the legal
    hearing that all citizens are guaranteed. The
    city's actions are a result of desperation
    because they were losing in court.

      Eventhough I don't live in your communities, I would like to point out that it's not the Police you should worry about, it's the people who RUN THE POLICE. I have to point out that the Police did their job here, at the request of the CITY. The use of Force was needed in this extreme by Police because the stupid politician wanted them to do something ridiculous. I feel for the Policeman that is used here like some puppet; the Police are changing more frequently to fit the needs of the community moreover than the politicians that run them. Perhaps the real focus should lie ONLY on the CITY. Don't fight two fronts here, fight the CITY, not the Police because Police are the CITY's decoy to all the MEDIA hipe. Get my point?

      Again and again, we hear of the system failing and that the police relished in yet another bashing of our civil rights. Well I put it to you, the authors of this, WHERE on earth did these people get the idea that they could just move in and take over????       While it's true that this story was not about bashing the pigs, perhaps those of you who love them so much should try walking in the shoes of the ones who have been abused by them.I'm not stereotyping all cops, but rather making(what we call in the world of psychology) a generalization. You see, all I've ever known of any police department,and I've seen quite a few, is harrasment, racism, brutality, and vulgarity! I'm curious how you can claim to know so much about the interior conditions of the squatted buildings--or are you just assuming that people lived for over 10 years in those buildings without plumbing or electricity. Sorry to bust your "Gush Lamebag" bubble, my friend, but as a local resident and one who had been inside the buildings during the inspection by Judge Wilk and MANY police and city officials, I can attest that you are indeed wrong. Those buildings were complete with full facilities--lights, running water, toilets, bath tubs and showers-- all functioning. They were installed by the occupants of the buildings which were abandonded and otherwise left to decay....not to mention that they were a haven for drug dealers....until the people who "squatted" them drove out the drug dealers (with no help from the police, who in many cases turned a blind eye or were paid to look the other way) and created a viable housing cluster and a positive contribution to the local community. I am certainly not a liberal, and I'm sure that you would be hard pressed to find a liberal squatter. If you do puke, please contain it within your own boundaries and dont spew it upon others.

      Several weeks ago the New York Times Magazine ran a photo spread on the inside of the squats. They showed how poor folks, who would probably be living in a homeless shelter if it weren't for the squats, have made a life and beautiful, comfortable homes for themeselves. Those people who always claim the answer to poverty is personal responsibility are really just ass licking white supremacists because of course when people are responsible for themselves then the riot cops with the machine guns show up. But its one year later and the squatters are still in their homes. They won, the cops and their guns were crushed. Get used to it.

      Sounds like the police did a good job!!! I wonder where the "squatters" got the idea they could take over buildings that they neither owned nor rented. Also, I would encourage the police to use whatever means necessary to protect themselves from that caliber of individual. It would be very naive to assume that a group of that type did not possess firearms or other weapons. Too bad the any violence the photographers was able to catch was the photo of the woman being carried away by the officers - I wonder why that is?

      8/16/96 One week ago we got word that the courts had decided to evict the remaining houses on the north side of 13th street. since then a whole community has spent a week without sleep as we came together,first to hold off the evictions and then to express our outrage.I wonder if any of the COPS who contribute to this letters page can justify the arrest of twent people at a completely nonviolent protest. In spite of the tragedy these evictions represent,the spirit of rebelion of many people ,black,white and latino, was a beutiful thing.WE NEVER SLEEP! WE GO THROUGH BRICK WALLS! Well how many rich people would move into someone elses building without permission?       From the "feedback" below it is obvious that there are disperate opinions of the above story. I personally think squatting should be legalized, merely for the fact that those who live in abandoned buildings often leave it in better condition that they received, or took, it. These buildings are held by the government anyway; and they are only going to stick others in them. So, why not let the squatters have them? It is absurd to FORCE the ("illegal") squatters out and put ("legal") squatters in. Either way, there residence is subsidized by the government.

      The fact that these people needed a HOME, and were ousted, just shows that laws are not moral, they're just laws. I find it appauling that the the city obviously does'nt care about the homeless. And for those of you who support their eviction, you are really supporting the "HAVES" making money on the backs of the "HAVE NOTS". Fight the war, the war with yourself.       I am a police officer,and some of the views expressed concern me for several reasons. First, none of you have walked in my shoes. For myself and the officers that i know, it would be great if we could just tell people "leave" and they would;or say "you are under arrest for X" and the person just sat down in my patrol car. The reality (that obviously you do not know)is that society is a mess. Police act as social workers, care givers, and law enforcers. We can be the least desired or the most desired person in just a flash of a second.

      it is interesting that so many people (who have never squatted) have such violent opinions on how "filthy" squatting is. Do you really think people would live somewhere for 10 years with no plumbing, no heat (in NEW YORK!). Squatter's rights are given in Europe, why not here?! If you take over an abandoned building for 7+ years and can show proof of residence, you get to keep that building. All you commentators ASSUMED that these people were living in squalor RENT FREE for 10 years. I'm PRETTY SURE they had the water turned on and the electricity (I've squatted in places that had both still on) All you have to do is pay the bill. Some of you have (mis)conceptions in your head of the poor and the homeless that are based on ignorance and an assumption that everything you hear or read is the truth (without personal life experience). From what I've seen, a small percentage of this culture has (by nature of a hierarchy) power over a larger percentage, and recognizing that those-who-have-not would like some, even just a little, they would like to keep what they have BY ANY MEANS NECESSARY. And this may mean employing brute force (i.e. the police) to do their dirty work for them to harass the poor and the destitute. And don't sit there and bitch to yourself and think that I don't know what I'm talking about. I CHOSE to be homeless IN ORDER TO witness what the police do to our citizens. When I found out that homeless people are more kind, generous, honest, loyal, and grateful than anyone in 'civilization' I decided to stay with this lifestyle, and have been travelling and squatting for the past 2 years now. The police are not the problem, it is the system. But the system influences all things in this culture, and when the system is corrupt, the society is corrupt. ~~story~~

      This incident is only one of a growing number of alarming incidents where the government(state, federal, etc.) is using excessive force to impose its will. Eugene, Los Angeles, Chicago, NYC. This is a trend that will not stop, it will only become more frequent. Every day Federal and State "authorities" entrench themselvse and expand their power, why does the FOREST Service need special para-military operatives to enforce laws that violate the very Constitution this country is founded on.       Much land in my town of Providence is owned by Brown University-the schooll is exempt from paying taxes.The school obtained the land from a grant from the King of England (1767).The king obtained the land by authority of colonizing it (squatting).       police suck! If the buildings aren't being used, then let people who don't a place to stay, stay there and work out a compromise. It's definately a soulution to our homeless problem.       I support the police activities when with their actions align with 1. Morality and compassion and 2. the law, as outlined by the U.S. Constitution and supporting State Constitution. According to the feedback responses I have read (about 80% of them), they have missed the point entirely. The squatters were following the prescribed procedure to address their grievances, which is a fundamental right, when the law was circumvented and their rights were trashed. The point is - Personal Rights/Freedom. As a Republic (which we, the U.S., have only in theory now) I am gauranteed several items outlined in the Constitution. No one, and I repeat, NO ONE, singular or majority, can alter, reposses, or take away those rights. What happened to those people was wrong, and unlawful. Focusing your attention only on the city, or on officials, does not prove adequate enough. The people under Adolph Hitler could not claim they were only following orders! In the same light, these officers are just as much to blame. They did NOT have to do what they were told...they have freedom of choice! Let's suppose that these squatters were guilty of...whatever. The punishment must fit the crime. I find it hard to rationalize military and gestapo like tactics employed against people excercising their right to peacably assemble. I lived and worked in a homestead on east 7th. about nine years ago. The experience alone was worth the effort, for to survive in New York city while pursuing a career and living very primatively, at first, influenced my early years as an artist and human being.       What a terrible and yet typical story! And what's worse, I just heard about it, YEARS after the fact! Make no mistake, what the police did was wrong, but they didn't do it on thier own initiative. YES, there are bad cops, and there will always be bad people who want to be cops for the wrong reasons, but it is up to the "operating system" to police its own ranks, weeding out such individuals and preventing them from ever being hired. We need cops, because there ARE bad people out there who don't give a fuck about our fancy politics or our faith in mankind, and those people will rob, rape and steal from us, they will physically hurt us and laugh because they are bigger and meaner and they think that's funny. Without a collective "posse" of sorts, bigger meaner people will continually get away with it. Sadly, that's just human nature. In fact it is the same human nature that drives the rich and powerful, those who enjoy privilege by birth, to defend thier stations in life by opressing the rest of us. Law enforcement was never the issue here, because the law was never enforced. As I see it, the police were told to ignore the law and "enforce" a private agenda. Who ordered them to do that? Who was able to circumvent the ruling of a judge? Who was likely to make any money from all of this and who prevented this from being bigger news? Those people are the true criminals, and the rest of us are all equally victims, even the cops.

      Those of you that look at this, if all you can see is justice done and trespassers evicted then you are not so aware of your surroundings. 13th was people making the best out of what was available, taking buildings that the City had left vacant, and making something of them. Building a community. The City felt a loss of control, seeing people living lives that they themselves had built. This was more than an eviction, it was a show of power, it was the City reasserting dominace. In such a case, it appears rather understandable that people are erecting barricades in the streets in order to keep the police from kicking them out of their homes. If you and your neighbors were involved in an ongoing property dispute with your city's government, and it decides to ignore the court and bring in police officers -- in assault vehicles -- to clear out the neighborhood and throw all of you out into the street, wouldn't you want to resist too? Especially if the law was on your side. Now, maybe the courts would eventually find the squatters to be living in the buildings illegally and order them to leave, but that's an entirely different thing from the city unilaterally deciding that they must go just so they can tear down the buildings that the squatters spent ten long years making habitable again and put up nice spiffy condos that poor people could never afford, or maybe housing projects that bring in lots of federal funds for the city but that are only nominally livable.       Well, after reading some the feedback below I am amazed at how ignorant some people can be. The police are not our friends and they are not here to protect us, but to protect the rich and their property.       We all need to get together and form an organization to publicize our cases. I was hired by the city of hampton virginia and worked there 8 years as a firefighter\emt. For 2 years I served as an emt cardiac tech. My supervisors Lt. Donnie Fromal and Lt. Joe Stevens ordered me to let black people die on 911 calls. Although I never followed these orders my co-workers did and I have documented numerous cases where this happened and need help getting them prosecuted for 1st degree murder. Infact this government is responsible for there even being squatters. The problem stems from the country being run by big corporations who pay wages that barely support one person let alone a family that might have to live in a squat. I don't believe we should blow up police stations or say "Fuck the Cops" that won't solve anything. We can't say the squatters deserved what they got either.Nobody deserves to be treated in such a vicious way. I have no respect for a country that would allow these people to be treated so unfairly. Would you rather have them on welfare being supported by our taxes. most of you people who stated that "they got what they deserved" probably want to eliminate welfare as well. You go ahead and act like you are so special because you can support yourself and you were able to go to college. Some people have circumstances that prevent them from even finishing High School. Seems to me that the this same exact situation (on a much larger scale of coarse) occured about 230 years ago when the citizens of what we now call America were suddenely put under the control of their "leaders" (Britin) after being neglected and abandoned for many years. All their hard work and efort put at risk. Its sad to see that we are oppresing the same ideals that once led to our freedom.       I was in 541 when it was evicted. I'd lived there many years. It's great to see the evictions still being discussed so long after it happened. Some news to supporters and detractors: NO ONE, not the new york times or cnn has ever gotten the real story. The evictions were illegal. The city was _losing badly_ in court when we were evicted. The executive branch (aka the mayor) can temporarily overrule a court decision it find unfavorable. This law is supposed to shield New Yorkers from judicial error. It is supposed to be used to protect New Yorkers. It is, as written in the legislation, not supposed to be used to circumvent the courts and allow action. If a wing-nut judge found that NYPD had to be disbanded because of Civil Rights Abuses, the city can legally say: no, I don't think so.... this needs further review. In evicting us squatters nothing of the sort occurred. The courts had found the buildings _safe_. And found our claims of ownership persuasive. NYC wrongly invoked it's sheild-law stay in order to have the buildings evicted. No, the squatters weren't outlaws. The city, really, truly, was. The city acted illegally. Before you knee-jerk anti-squatter respond to this, check the facts... go to the court records, not the newspapers. Reporters work under very severe time constraints, as a result legally complex issues are _always_ very poorly reported on. It was convenient to report on this case as : freethinking wild-hair squatters innocent artistic types try to buck societal rules and regs and get busted by the city. That's everyone's preconception, that's the story everyone was ready to hear. It has nothing to do with reality. Bizarrely perhaps, but all the same true, our legal team kicked the city's butt. Please try to understand this: The courts, not me, not the New York Times, the courts had _already_ found in favor of the squatters, had already totally rejected the city's claims that the building were in danger of collapsing. We had recently completed repointing the brickwork on 541 East 13th street. Please, if the city was concerned about the squatter's health/lawsuits, they would have evicted us when we entered the dilapidated windowless rubble-filled building at 541 East 13, not 10 years later, after we'd repointed the walls, ousted drug-dealers from the block, cleaned up the enitre building, put in new plumbing, and new windows and electrical service, set up a neighborhood soup kitchen (at 539), created a bike shop that rebuilt abandoned junk bikes (also at 539) and gave them to neighborhood kids, created a real working blacksmith's forge (at 545 E 13) that trained locals in that lost art. Funny how Guliani bent over backwards to evict us only after a real-estate developer and democratic city councilman Antonio Pagan (who'd bucked the party and endorsed Republican Giuliani over dem David Dinkins)decided he wanted to develop that block. Sure there was a downside to the squatters, we had our share of wacko's and losers and bums, but, uh, pardon me... take a look around: Do you see any shortage of wackos losers and bums anywhere? By the way, anyone who thinks squatting is living rent-free, should squat in NY for a month or two. It ain't free. It's a helluva lot easier to pay rent, as I do now. But squatting was and is a political statement against the status quo. A way for the financially and politically disenfranchised to get not only a place to live, but to set down roots in a community the way _only_ a property owner can. A way to perhaps acquire some of the political clout that_only_ property owners have. Renters are the transients (spritually if not always literally), on whom the landed gentry feed. In NYC Real Esate is king. Squatting was and is a political movement that threatens the underpinnings of the United States class system. No wonder the city took us seriously enough to violate their own laws to get rid of us. In Brazil, they massacre the poor peasants who have the nerve to claim ownership of unused land, who seek to toil and work the land for their own profit rather than the profit of their masters. I suppose us US squatters should feel lucky that we are only beaten and illegally evicted, it could be worse eh? For what it's worth, I praise the policeman who did not shoot a 545 squatter. A squatter should have, could have, been killed at the evictions. He tried very hard to get himself shot (he was invincibly drunk at the time, and with an assault rifle pointed at his chest, and a swat cop telling him to put his hands over his head NOW... instead made a fast unmistabeable motion of reaching for a weapon in his waistband... he had no weapon, he was trying to get shot. Incredibly, the cop didn't shoot. If he had I would have testified in court on behalf of that cop. Shooting would have been justified. To this day I don't know why the cop didn't fire: bless him, enough if he did kick our asses illegally into the street and is a tool of forces he doesn't quite understand. First of all, I think the people who oppose it are just mad because these squatters found a way of life that didn't involve working your fingers to the bone 40 hours a week, just so you can feed yourself. But what the politicians did to these people is the equivalent of kicking you out of your home, and taking away you're source of income. The only ones who benefit from this are the people who run the city.       This is just one more example of making money a higher priority than individual happiness. I suppose it's a flaw in capitalism that elevates money to such levels, and I shouldn't complain since I have no better solution. But I can't understand why people can't be just a little nicer and see that their own profit margins can't possibly be as important as someone elses welfare. I don't think that this is about the police at all, but about the distorted priorities of those in power, both politically and financially. It's completely acceptable to throw more than a hundred people out of their homes because of a legal technicality, and it's commonplace to lay off thousands of hard working people if you need to "streamline" your corporation. I absolutely don't understand how we justify this type of mentality. To me, this situation is just one example of the distorted priorities and values we carry in this country. I think I might move overseas.

      I was punched, stomped, kicked and struck with rifle butts, by members of the Missouri State Highway Patrol; which left me physically scarred for life. After the beating, I was taken to the Pulaski County Hospital for treatment. I submitted to a polygraph test ( prior to the hearing ) and passed successfully, confirming my charges and proving the trooper's charges to be false. I was still sent to prison for 3 yrs on false charges.       I do not feel that the police should have interviened in this situation because the judge made his judgement. I do not see how HDP has the athority to send the police into a cituation of that occord. That is the job of the judge to issue warrents. Since He /She did not issue the warrent, the sezure was unconstitutional and should have never happened.
