Illegal Detainment/ Arrest/ Search in San Leandro CAlifornia

  • Hello, I have been searching for information regarding illegal arrest and police misconduct. I have spent the last 5 days looking at penal and civic code. I am so confused. I had an altercation with the San Leandro Pd in California Sunday evening. I was pulled into a parking stall next to a handicapped space. I was im the area with the white hash marks in it. My friend ran in to get some cigarettes and came out in 2 minutes. She was back in the car and I was begining to pull away when i heard a male voice ask if i was handicapped. I turn and said no. A man in a police uniform told me I was parked in a handicapped stall. I opened my door and showed him the painted wheelchair on the ground in the other parking space. He then ordered me to get out of my car. I asked him why , he demanded I get out of my car. Keep in mind that I did not even know if he really was a cop or not. I again asked him why and he proceeded to walk away from my car. I shrugged and began pulling out of the stall. I turned out of the parking lot and he followed me. He pulled me over and said fine then, how about reg, liscens, insurance. I of course complied and asked him why I had been pulled over. He refused to tell me. I asked him his name and he refused to tell me. I gave him the information except for proof of insurance. I stated to my friend that I knew I had it but could she help me look for it. To this the officer stated awww, you have no insurance and he walked away from the car. I then got out of the car and told him I was still looking and asked him why he was treating me this way. I told him he needed to tell me why he had pulled me over. He then opened the back of his police car, grabbed my arm and attempted to push me in the car. I screamed for my friend who was in my car at the time and she jumped out and he let go of me. After a few minutes elapsed, another officer showed up and the first officer told my friend to get in the fucking car or she would be arrested. As he verbally abused her he began walking toward her, threateningly. I took one step toward the officer and did not touch him or threaten him but started talking about how we were citizens and they grabbed me and threw me on the back of the police car, cuffed me and frisked the outside and inside of my jacket. The officers were white males and i am a white female. I demanded to know why I was being handcuffed and they told me they did not have to tell me and that I needed to go take some law courses. I continued to ask why and the officer told me to get the fuck in the car and he looked like he was going to hit me. I did and then they stood outside laughing at me. I was yelling at them to let me out or tell me what was happening. I told them that I had had a broken elbow and a dislocated shoulder (kess than a year ago) and that my arm does not bend back that way and that it hurt. They just smiled at me. After 20 minutes they took me out of the car and released my right arm and I moved it to the front of my body because it hurt. I was physically restrained again by the officer who told me i could not move and he asked me if he needed to spell everything out for me. They then made me sign a ticket for lack of insurance and gave me aqnother ticket for parking in a handicapped stall. I spoke to their Srgnt. and have filed a complaint.
